Luxottica Wins Legal Action against 'Persol' Imitations
Following a sequestration order and injunction, with the subsequent agreement reached in September 2002 in a legal action heard by the Court of Bologna, Luxottica announced today that it had obtained the ban and final elimination of eyewear bearing the typical 'Persol' branding with the plagiarized reversed double arrows. This eyewear came from Asian markets and was placed on the Italian market by Wanted s.r.l. of Casoria, sold by P.M.C. of Funo di Argelato, and distributed in minimum quantities to retail outlets by Giacomelli Sport s.p.a., with tags that described the eyewear as 'Persol'.
In the same communication, the Agordo-based company emphasized that, as holders of the exclusive right to the 'Persol' brand and the reversed double arrows used to identify sunglasses and sight eyewear in the 'Persol' line, it will continue to watch closely for any cases of plagiarizing and will take the appropriate legal action to protect consumers and its own rights of exclusivity.
